Customs Procedure Commercial Terms, Conditions and Information on customs clearance for private persons

You are about to receive a shipment from abroad / outside the EU. Such a shipment is liable to customs clearance procedure, therefore, we kindly ask you to pay attention to the following information and instructions. The shipment cannot be delivered without the customs clearance. We offer you to use the services of DHL Express (Czech Republic) s.r.o., a company based in Nádražní 2967/93, Moravská Ostrava, 702 00 Ostrava, Czech Republic, Identification No.25683446, VAT No.CZ25683446, registred at Regional Court in Ostrava, part C, entry 27002 (hereinafter referred to as „DHL“).

If you decide for our offer, all can be comfortly done from your home. Just fill in the form below and the rest will be taken care of by DHL. This includes the issuance of the customs documents, customs commodity classification, communication with the Customs Office, arranging for entry inspections of the goods, providing for your potential customs duties towards the Customs Office. For your convenience, we operate regardless of the Office´s opening hours for public.

In case that the sender selected the additional service option Duties&Taxes Paid (DTP), the customs charges will be billed to the sender. However the shipment is still subject to the customs clearance in the Czech Republic and it is necessary to fill in the form below.

The freight costs for customs purposes

The freight costs are integral part of the base for VAT and customs duty calculation. We are obliged by law to apply the freight costs as per our pricelist, should there be no document proving the freight costs.

COMMISSION IMPLEMENTING REGULATION (EU) 2015/2447 Sec. 138 sub-sec. 3:

Where transport is free of charge or provided by the buyer, the transport costs to be included in the customs value of the goods shall be calculated in accordance with the schedule of freight rates normally applied for the same modes of transport.

In the event of importing from Asian countries (China, Hong Kong, Taiwan), the Customs Office requires to present the order confirmation and/or proof of payment for the goods and, if need be, also other documents on costs related to the purchase of the goods. The clearance is not possible without these documents.

Specification of the content of the shipment:

The accurate description of shipment content is used to correct customs classification which determinates the customs duty.

Notification about the current Customs Administration requirements:

The Customs Office always requires the proof of payment when you import the following commodities:

  • Mobile phones
  • Dresses including Wedding dress
  • If you importing to Czech republic D3 vitamin any quantity or any form the shipment customs clearance have to do customs authority physical. In this case DHL CZ have no affect how long clearance can take or when / if the shipment will be release by customs authority to delivery.

If DHL clears the shipment, the Advance payment will be charged for shipments customs cleared by DHL. This fee amounting to 2% of the total of customs duties, taxes and VAT, in the minimum amount CZK 550.- will be paid upon DHL’s notice in cash or by card at the delivery of the shipment. At the same time, upon DHL’s notice you undertake to pay all customs duties, taxes, including VAT, assessed by the Customs Office, possibly any other fees charged by DHL, or costs incurred by DHL, in relation to the customs clearing of the shipment, all in cash or by card at the taking over of the shipment. DHL shall not be obliged to hand over the shipment if the customs duties, taxes, including the VAT, and the Advance payment are not paid.

DHL Express (Czech Republic) s.r.o. has new customs fees and has some correction existings fees since 1.1.2018. Please check our price list on link below.

Types and amounts of respective fees chargable by DHL are defined in Services Pricelist.

Customs Procedure Commercial Terms and Conditions

By sending this form you and DHL enter into an Agreement on Customs Clearance of the Shipment (hereinafter only the “Agreement”) and you hereby agree that DHL may take the necessary steps for customs clearance of your shipment and for customs clearing the shipment immediately after the conclusion of this Agreement, without expiry of the 14-day time period for withdrawal from this Agreement. However, in this case you are not entitled to withdraw from the Agreement. It is deemed that the service is provided by the Customs Office’s decision on releasing the shipment, including partial release.

The shipment shall be customs cleared for DHL and DHL shall be specified as the declarant in the customs declaration, i.e. DHL will submit the customs declaration in its own name for your benefit.

You hereby acknowledge that pursuant to Sec. 1837 of Act no. 89/2012 Coll., the Civil Code, as amended (hereinafter only the “Civil Code”) it is not possible to withdraw from the Agreement besides others if the service under the Agreement is performed with your prior express consent before expiry of the period for withdrawal from the Agreement and if before the conclusion of an agreement DHL has informed you that in such case you shall not be entitled to withdraw from the Agreement.

Unless it is the case, other cases respectively, according to Sec. 1837 of the Civil Code when it is not possible to withdraw from an agreement, you shall be entitled to withdraw from the Agreement within fourteen (14) days from the conclusion of the Agreement.

If provision of the service has already commenced, DHL is entitled to compensation of costs already incurred in relation to the provision of the services under the Agreement. The form for withdrawal from the Agreement is available here.

Should you be of the opinion that we have failed to comply with the terms and conditions of this Agreement and/or with any other obligation resulting from legal regulations, you can submit an electronic claim at reklamace@dhl.com. In the claim it is necessary to state your contact data, the awb shipment number (the ten digit number stated in the text message), the subject of the claim and your proposed solution. Such information will contribute to the expedited processing of your claim.

If a consumer dispute that cannot be resolved by mutual agreement arises, you can submit a motion for an outside court settlement of such dispute to an entity appointed for outside court settlements of consumer disputes, which is the Czech Trade Inspection Authority, Central Inspectorate – ADR Department /Česká obchodní inspekce, Ústřední inspektorát - oddělení ADR/ Štěpánská 15, 120 00 Prague 2, e-mail: adr@coi.cz, web: www.coi.cz. You may also use the platform for online dispute resolution established by the European Commission at http://ec.europa.eu/consumers/odr/

The above provided is applicable only if you customs clear a shipment as a consumer in the meaning of Act no. 634/1992 Coll., as amended, and it is not applicable to the customs clearing of a shipment in connection with business activities and/or entrepreneurship.
